In Error to the Circuit Court of the United States for the Eastern District of Arkansas. Action by Wilbur F. Denious, trustee in bankruptcy of the estate of Roger H. Williams, against Jethro P. Henderson and another. Judgment for plaintiff, and defendants bring error.

POLLOCK, District Judge.

This case is an echo from the operations of the widely known Boatright gang of fake foot racers. The facts, in so far as material’to decision of the controversy presented, may^be briefly summarized as follows:

Roger H. Williams, a citizen and resident of the state of Colorado, one of the Boatright gang, on December 5, 1902, in the state of Arkansas, delivered to plaintiffs in error (for sake of brevity, hereinafter designated as “Henderson & Wood”) the sum of $9,795 in cash and certificates of deposit in bank.
