The claim of defendant in error (plaintiff), as shown by the statement filed, is based upon a certificate issued by plaintiff in error (defendant), dated December 19,1900, and issued to Hattie Goyt, in which, her husband, Andrew Goyt, was made the sole beneficiary. The defendant agreed to pay to Andrew Goyt the sum of $1,000 on the death of Hattie Goyt, provided the by-laws of the Order and other conditions of the contract were fulfilled, and subject to a provision that upon the death of a member the defendant should retain $50…
