Appeal from judgment of the supreme court, general term, fifth department, affirming judgment of Niagara county sessions, convicting defendant of the crime of arson in the third degree.

The defendant was convicted of tfie' crime of arson in the third degree. The evidence was purely oircum stantial, as it ordinarily is in the proof of this class of crimes. It is unnecessary to review it in detail, but it was sufficient, we think, if believed by the jury, to connect the defendant with the commission of the offense charged and to support their conclusion that he was the perpetrator of it.

On the trial two anonymous letters were introduced in evidence and, undoubtedly, bad an important bearing in securing defendant’s conviction. One was written to a woman in the employ of the…
