The defendant was the owner of a six-story office building in the city of Waterloo, and employed the plaintiff as a janitor therein. Hpon the outer wall of this building, the defendant, in obedience to law and to an ordinance of the city, constructed and maintained an iron fire escape. It was built upon the usual plan, with a platform at each floor above the first story, all being-connected by flights of stairs.
