This suit' in equity was instituted originally by plaintiffs upon a promissory note and grew out of the following facts as shown by the pleadings and evidence.

In July, 1916, the Nemo Oil Company of Oklahoma borrowed from plaintiff, a bank of Tulsa, Oklahoma, the sum of $6500, evidenced by its promissory note for that amount secured by a chattel mortgage covering the equipment on an oil lease then standing in the name of the Nemo Oil Company.
