MEMORANDUM AND ORDER
BELOT, District Judge.
This case comes before the court on defendant David Henderson’s motion for summary judgment. (Doe. 236.) Plaintiffs have responded and the court is prepared to rule.
Material Facts
Mildred Stevens was a doctor at Anderson County Hospital in Garnett, Kansas. Her clinical privileges have since been revoked. Stevens gave Krystal Dodd-Anderson (“plaintiff’) prenatal care and delivered Amanda, plaintiffs daughter, on May 19, 1991.
