WAKATSUKI, J.

The first circuit court granted summary judgment in favor of the buyers and against the seller for the return of $19,300 which was a down payment towards the purchase of a condominium apartment.

The seller appeals the circuit court’s judgment on several grounds: (1) that there is an issue of material fact as to whether Robin Jo Stevens was an intended purchaser; (2) that the circuit court erred in finding that the buyers were unable to secure a mortgage loan because of a material change in financial condition; and (3) that the circuit court erred when it…
