This is an action for the purchase price on an alleged contract of sale of shares of stock in the Janesville News, a newspaper which was published for a short time in that city. At the time of the transaction involved the plaintiff was a lawyer residing in Portage, defendant Burns was a merchant, and defendant Kennedy a real-estate dealer, both residing in Janesville. In the summer or early fall of 1919 there were negotiations' between the plaintiff and the defendants with respect to organizing a corporation to publish a newspaper to take the place of one which had suspended publication.
