MEMORANDUM OPINION AND ORDER

This Memorandum Opinion and Order constitutes the Court’s findings of fact and conclusions of law regarding the Motion to Dismiss filed by the United States Trustee (“Trustee”) and the Opposition to the Motion to Dismiss filed by the Debtor, Fred A. Summer (“Debtor”). This litigation is based upon section 707(b) of the United States Bankruptcy Code (“Code”), that provides for the dismissal of bankruptcy cases where granting chapter 7 relief constitutes a substantial abuse. 1 The Court has considered the testimony, exhibits,…
