When the will of the decedent was offered for probate, objections to the probate of the will were interposed by Florence Jane Foreman, the widow of the decedent. The trial of said contest was then begun before one of the surrogates of New York"'county and a jury and after said trial had continued for three days a settlement was arranged, with the approval of the surrogate. Under such settlement it was agreed that the will should be admitted to probate, but that the contestant’s share in the net estate of the decedent should be increased to twenty-six per cent thereof.
