MEMORANDUM OPINION

(October 19, 2012)

THIS MATTER is before the Court on the Motion for Default Judgment filed by Plaintiff Bank of Nova Scotia (“Scotiabank”) seeking judgment for debt and foreclosure against all Defendants.1 Upon consideration of the motion, it presents the Court with issues not previously addressed by Virgin Islands courts with respect to the quantum of proof required to support a motion for default judgment, and the parameters of fictitious party practice under the rules of this Court.
