Plaintiff had judgment in this action to ■ recover damages resulting from injuries sustained by a fall on a sidewalk alleged to be defective, and the defendant appeals.

At the time of settling the bill of exceptions, counsel for respondent asked the court below to insert therein théir objection and exception to the introduction of a certain exhibit received in evidence on appellant’s behalf. Such request being denied, a similar application, supported by affidavit, is made to this court, with the suggestion that, in disposing of the case, the same be considered as a part of the bill of…
