RAYMOND T. LYONS, Bankruptcy Judge.

Rebecca Howell, the estranged wife of the Debtor, Glenn Howell, moves for relief from the automatic stay to proceed in state court for an equitable distribution of marital property. Under state law, the right to equitable distribution does not arise until a judgment of divorce has been entered; thus, Rebecca Howell’s pending state court complaint seeking divorce and equitable distribution is not a claim that arose before commencement of this bankruptcy case.
