Tie appellant, who was the plaintiff below, brought this suit in the Jefferson circuit court against appellee,, defendant below, to recover damages for personal injuries. At the close of the evidence for the plaintiff the court peremptorily instructed the jury to find a verdict for the defendant, and, from a judgment entered on that verdict dismissing plaintiff’s petition, he has prosecuted this appeal, insisting that the evidence was sufficient to take the ease to the jury and the court erred in sustaining defendant’s motion for a…
