Robert Preston died after his motorcycle hit a median on Johnson Ferry Road in Cobb County. His parents, Richard and Johnnie Preston, brought a wrongful death action against Parham Sabetazm, alleging that he negligently and recklessly “drove his vehicle in such manner as to cause [Preston’s] motorcycle ... to collide with [the] median. . . Sabetazm claimed, among other things, that he and Preston were racing at the time of the collision, and he raised the affirmative defense of assumption of the risk.
