The defendant Connell Rogers, as county treasurer of Muskogee county, on the 28th day of January, 1910, gave notice in writing to plaintiff, Louis Duncan, that information had been filed in his office that plaintiff was the owner of personal property, consisting of notes and mortgages of the value of $12,000, omitted from the tax rolls for the year 1908, and $80,000 for the year 1909.
