Now pending before the Court are Plaintiff’s and Defendants’ cross motions for summary judgment. (Docs. 68, 70.) On January 10, 2017, the Court held oral arguments on the motions. (Doc. 79.) The facts presented in the motions fall within the arena of workers’ compensation insurance, which uses a complex formula to calculate an employer’s annual premium.
