’ .The plaintiff, as administrator .of tbe estate of Andrew Dnfva, deceased, seeks to recover from tbe defendant possession of five certificates of deposit aggregating $2,500, claiming they belong to tbe estate, Tbe defendant says that Andrew Dnfva.during bis last illness made bim a gift of these certificates and under circumstances wbicb impressed tbe giver with expectation of .speedy deglh. .

•The only testimony offered was offered by the defendant and at tbe close of. tbe case both sides moved for a directed verdict. Tbe trial court made findings and conclusions in favor of tbe defendant.…
