GALLEGOS, District Judge.

In August, 1955, John T. Lanehart filed suit to quiet title alleging that he was the owner of an undivided V4 interest in the oil, gas and other minerals in the NEJ4 of Sec. 21 and the NW}4 of Sec. 22, Twp. 25, Rge. 37 E. (160 acres) in Lea County, New Mexico.

The defendants, heirs of seven deceased brothers and a deceased sister of John T. Lanehart, appellee herein, answered claiming an undivided interest in the minerals and counter-claimed against the plaintiff and against the third-party defendant, Argo Oil Corporation, for an accounting of the defendants’ portion…
