OPINION AND ORDER

¶1 Gregory J. Jellison (Jellison) petitions this Court for writ of habeas corpus. The State of Montana (the State) has filed a response opposing Jellison’s petition.

Factual and Procedural Background

¶2 On July 3,1999,122 inmates at the Montana State Prison participated in a sit-down demonstration in the High Security yard of the prison, adjacent to the high security gymnasium. When the demonstration began at 2:30 p.m., Jellison was exercising in the gymnasium.
