BYERS, District Judge.
The plaintiff sues as administrator of his deceased son, Harvey H. Johnson, under the Suits in Admiralty Act of 1920' (46 USCA § 741 et seq.), to recover damages for the death of the latter, who was an able-bodied seaman on the steamship West Honaker.
The ship was being operated by the Roosevelt Steamship Co., Inc., for account of the United States Shipping Board Merchant Fleet Corporation, and was on a voyage which started in New York on March 7,1929, destination Calcutta, and return.
