HARPER, Judge.

— Appellant was indicted, charged with murder and convicted of murder in the first degree, and his punishment assessed at imprisonment in the penitentiary for life.

It appears that Frank Wisnoski, appellant, resided in Thurber, and Walter Cukierski, Tom Mulkowski and John Zeilinski boarded with him. On Sunday night, May 26, 1912, the Polish residents of Thurber had a celebration at the home of Jake Sabota, and all the above four attended.
