MEMORANDUM OPINION
HILTON, District Judge.
This matter came before the court on defendant’s motion for summary judgment. Plaintiff Ilona K. Buko filed this action on February 2, 1993, against Defendant American Medical Laboratories, Inc., (AML) alleging in Count I violation of the Age Discrimination in Employment Act, 29 U.S.C. § 623, et seq., as amended; Count II, discrimination in violation of the Rehabilitation Act of 1973, 29 U.S.C. § 794; and Count III, discrimination in violation of the Employment Retirement Income Security Act, 29 U.S.C. § 1132.
