To avoid confusion in referring to the parties to.this appeal, the appellant, city of Milwaukee, will be called “city,” and the respondent, A. Gettelman Brewing Company, will be called “company.” The company’s property, which is involved herein, consisted of a parcel of land with a frontage of twenty-five feet on West Kilbourn avenue and one hundred feet on North Sixth street. Upon the land there was a two-story brick building, with living quarters on the second floor, and store premises on the first floor which were used for a tavern and a restaurant.
