The plaintiff brings ejectment to recover possession of the land occupied by a section of defendant’s railroad. The premises were formerly owned by one David Stewart, who, on the 19th day of July, 1872, entered into a contract with the Gloversville & Northville Railroad Company, by which he agreed to sell and convey to said company, by a good and sufficient warranty deed, free and clear of all incumbrances, all the land said company desired for the construction of its railroad across his farm in Mayfield, N. Y., for the sum of $100 per acre for bottom land, payable in the stock of the company…
