On April 21,1911, one James B. Turn-bull was the owner of lot 5 on James street in the city of Utica and on that day he entered into a contract in writing to sell said lot to defendant Delpho for the sum of $1,000, of which sum $100 was to to paid down and the balance on or before November 1,1911. Said sum of $100 was paid on the execution of the contract and Delpho went into possession of the property. Delpho was a builder and for some time had been engaged in business with one Wadsworth L.
