It is ordered that the petition (No. 001) served and filed in this special proceeding to compel respondent’s compliance with *1138a subpoena issued by the petitioner is considered under CPLR 2308 and is granted.

The petitioner commenced this special proceeding pursuant to CPLR 2308 for an order and judgment directing the respondent to comply with a March 4, 2010 subpoena issued by the petitioner.
