In an action to recover damages for personal injuries, the defendant 376 St. Johns Condominium, Inc., appeals from an order of the Supreme Court, Kings County (Ruchelsman, J.), dated July 2, 2003, which granted the plaintiffs motion for summary judgment on the issue of liability on his cause of action to recover damages for violation of Labor Law § 240 (1) and denied its cross motion for summary judgment dismissing the complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof denying those branches of the cross motion which were for summary judgment…
