The present action arises out of an incident of alleged police misconduct which occurred on March 15, 2007. Timothy Morrissey (“Plaintiff’), a diabetic, has filed an action asserting claims pursuant to 42 U.S.C. § 1983, the Massachusetts Civil Rights Act (“MCRA”), Mass. Gen.
