This is an original proceeding in babeas corpus by tbe petitioner, Tex R. Brown, who is confined in tbe Oklahoma State Penitentiary at McAlester.

In the verified petition it is alleged that on September 21, 1946, tbe petitioner entered a plea of guilty to the charge of larceny of an automobile, second offense, in the district court of Pottawatomie county, Okla., and was sentenced to serve seven years in the State Penitentiary.
