DUVAL, District Judge.

Before the court is a motion to dismiss Plaintiff Tom Beanal’s (“Beanal”) claims against Freeport-McMoRan, Inc. and Free-port>-MeMoRan Copper & Gold, Inc. (collectively “Freeport”), which motion was heard with oral argument on October 23, 1996.
