Before the court are cross-motions for summary judgment filed by debtor/plain*863tiff James Blackston (“Mr. Blackston”), defendant Setenas, Inc. (“Setenas”), and defendant Bank of America, N.A. as successor by merger to BAC Home Loans Servicing, L.P. (collectively “BANA”). See ECF 49, 50, 52, 53, 60, 64, 69, 70, 71, 77, 85, and 86. Mr. Blackston’s claims are based on his contention that BANA, and then Setenas as the successor-servicer, acted contrary to the loan documents by revoking the escrow account waiver on his deed of trust…
