(Dissenting.) This is an action to recover damages alleged to have been sustained by plaintiff while operating a half-ton Ford auto truck upon the highway near Multnomah station. Plaintiff was traveling in an easterly direction. A Yelie automobile was upon the highway, ahead of plaintiff, traveling in the same direction. Defendant was behind plaintiff traveling in the same direction and driving a Ford tndor sedan.
