Under the qui tam provisions of the False Claims Act (“FCA” or “Act”), 31 U.S.C. §§ 3729-3733 (2000), any person may initiate a lawsuit in the name of the United States for substantive violations of the Act. The United States, through its relator Alva Bettis (“Bettis”), brought this action in the District Court against Ode-brecht Contractors of California, Inc., et al.
