— The present case comes before us in. a form different from that presented hi Perry County v. S., M. & M. Railroad Co., 58 Ala. 546. An application was made to the court below, for a mandamus to the auditor, directing and commanding him to complete and apportion the assessment of the Memphis and Charleston Bailroad Company for the years 1870 to 1874, inclusive, and to notify the assessor of Jackson county “ of the number of miles of track, and value thereof, and the proportionate value of personal property taxable” in said county.
