Plaintiff, Jerome Tibbs, is currently under the lawful custody of the Department of Correction (“DOC”) at the Souza-Baranowski Correctional Center (“SBCC”) in Shirley, Massachusetts. Plaintiff brings this action in the nature of certiorari under G.L.c. 249, §4 against defendants Paul Dipalo (“Dipalo”), the Superintendent of SBCC, M.
