MEMORANDUM OPINION

RICHARD L. WILLIAMS, District Judge.

This case came before the Court on the defendants’ motion for summary judgment under Rule 56, Fed.R.Civ.P. By their motion, defendants sought dismissal of all claims alleged in the complaints filed in this action and in Civil Action No. 88-238-R. At a hearing on April 27, 1988, the Court granted summary judgment for the defendants, only on the seventh cause of action in the amended complaint filed by the plaintiffs Barris Industries, Inc., GIANT Group, Ltd. and KCC Delaware Company.
