—In an action to recover damages for personal injuries, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Yoswein, J.), dated June 27, 1995, as denied his motion for leave to enter a default judgment against the defendant Jacob Fleischer and granted that defendant leave to answer the complaint.

Ordered that the order is modified by deleting the last decretal paragraph thereof and substituting therefor the following: "the plaintiffs motion for leave to enter a default judgment against the defendant Jacob Fleischer is denied without…
