NORTON, District Judge.

This declaratory judgment action comes before the court on cross-motion for summary judgment.

I. Background Facts

During the 1980s, Joseph L. Tamsberg, a residential developer, built Saddlebrook Manufactured Home Community, a mobile home park, in Dorchester County, within the city limits of North Charleston. The owners of Saddlebrook own the property in fee simple and lease each lot to a tenant.
