Memorandum: On appeal from a judgment convicting him of criminal sale of a controlled substance in the third degree and criminal possession of a controlled substance in the third degree, defendant contends that the jury’s verdict is against the weight of the evidence because the People failed to disprove his alibi beyond a reasonable doubt.
