By her last will and testament Josephine B. Byers, late of Essex County, mother of the complainant, in paragraph 12 of said will, provided as follows:

"I give and bequeath to my Trustee to be appointed in the manner hereinafter provided, the sum of Sixty-five thousand dollars, in trust, to invest and reinvest the same and collect the income therefrom and pay said income to my said daughter, Anna Byers, during her life, which income shall begin with the date of my decease; and upon her decease said trust shall cease and determine and the principal thereof and any unexpended income therefrom…
