WARRINER, District Judge.

This action arises under § 502(a)(3) and (f) of the Employee Retirement Income Security Act of 1974 (ERISA), 29 U.S.C. § 1132(aX3) and (f), and involves the rationality and legality of the pension trustees’ construction of a “break in service” rule. The Trustees of the International Association of Heat and Frost Insulators and Asbestos Workers’ Local 24 Pension Fund (Pension Fund) filed this action seeking repayment of pension benefits allegedly improperly paid defendant pensioner from the Pension Fund.
