MEMORANDUM AND ORDER

This case is before the Court on Defendant’s Motion for Summary Judgment (Doc. No. 70) and Plaintiffs Cross-Motion for Summary Judgment (Doc. No. 74). For the reasons set forth in the attached Memorandum, these Motions will be GRANTED in part and DENIED in part.
