The relator obtained an alternative writ ot mandamus to compel the defendant to report certain fees received by bim as clerk of Lancaster county, including tbe sum of $400 allowed bim as salary under tbe provisions of section 14, chapter 22, Gen. Stat., 380, and tbe sum paid bim for making out tax lists for tbe year 1879, as required by tbe act of 1877. Laws 1877, p. 45.

Tbe defendant answered tbe writ, alleging that it was not bis duty to report to tbe county commissioners of said county tbe sum of $667.80 received by bim for making out tbe tax lists. That defendant did…
