OPINION
TIPTON, Judge.
The defendant, Kenneth M. Seaton, Jr., was convicted by a jury in the Sevier County Circuit Court of driving while under the influence of an intoxicant (DUI) and received a sentence of eleven months, twenty-nine days in jail, of which all but forty-eight hours was suspended, and a fine of two hundred, fifty dollars. Both the defendant and the state have appealed as of right.
