Introduction

Arlee Hayes (Appellant) appeals from the trial court’s judgment entered after a bench trial convicting him of second-degree murder and abuse of a child resulting in death. We affirm.

On April 28, 2010, the State charged Appellant with second-degree murder or felony murder (Count I) as a result of the perpetration of the class A felony of abuse of a child (Count III) and, in the alternative, with second-degree murder or felony murder (Count II) as a result of the perpetration of the class C felony of second-degree assault (Count IV).
