On September 19, 2000, petitioner, Ricardo Guzman (“Guzman”), following a jury trial in New York Supreme Court, Kings County, was acquitted of intentional murder but convicted of depraved-indifference murder; 1 he was sentenced on October 10, 2000, to an indeterminate sentence of twenty-five years to life imprisonment.
