The facts and procedural history of this Federal Tort Claims Act (“FTCA”) action were detailed in our earlier opinion, Fried v. United States, 579 F.Supp. 1212 (N.D.Ill.1983). {“Fried I”), and will be briefly noted only to the extent that they bear upon the issues presently before us.
