MEMORANDUM AND ORDER

In this class action the plaintiffs seek an accounting, damages and injunctive relief for alleged (1) violations of the Consumer Credit • Protection Act (Truth in Lending Act), 15 U.S.C. §§ 1601, 1605, 1636, 1639, 1640; (2) violations of the Sherman Anti-Trust Act, 15 U.S.C. §§ 1, 2, 3; (3) unjust enrichment; and (4) breach of contract. The class of plaintiffs is composed of all persons in the Houston metropolitan area who have obtained a loan secured by a deed of trust on real property from one of the class of forty defendant lending…
