On October 17, 2007, plaintiff Metso Minerals Industries, Inc. (“Metso”) filed suit against FLSmidth-Excel LLC (“Excel”). In the ensuing years, Metso filed several amended complaints, adding numerous new defendants. In Metso’s fifth, and final, amended complaint, it alleged that three of its former employees — Martinez, Sullivan, and Olson (“the former employees”) — committed breach of contract by violating nondisclosure agreements.
